Criminal complaint filed with CBI against Smt. Sheila Dikshit for misappropriation of public fund and criminal breach of trust.

  • Sheila Dikshit also committed criminal misconduct punishable under Prevention of Corruption Act, 1988. 

New Delhi, 6th June, 2013. In a joint press statement issued here today BJP Delhi Pradesh President Shri Vijay Goel and former Delhi Pradesh President Shri Vijender Gupta have informed that a criminal complaint has been filed with the Director Central Bureau of Investigation against the Chief Minister of Delhi Smt. Sheila Dikshit for criminal misappropriation of public finds and criminal breach of trust by misusing Government machinery and public funds on publishing false advertisements during the election campaign in the year 2008-09. 

Both the aforesaid leaders said that a number of government advertisements were published in the form of publications in newspaper, hoarding showing pictures of Smt. Sonia Gandhi chairperson of UPA and Smt. Sheila Dikshit all over Delhi and also in form of Radio Jingles, misusing the Government machinery and public funds and burdened the State Exchequer in carrying out campaign of Congress Party for her own political gains. Ms. Sheila Dikshit used public funds for her own use and use of Congress Party for her Party’s political campaign. Government advertisements were carried out in any manner which resulted in public funds being used to finance publicity for party, political purpose, Government advertisements entail payment from public funds.

Smt. Sheila Dikshit was also the Minister in Charge of Information and Publicity during the time these advertisements were issued. Smt. Sheila Dikshit was directly responsible for it. In aforesaid election year advertisement were issued by Directorate of Information and publicity on direction of Ms. Sheila Dikshit with improper and selfish motive to obtain gain or favor for herself and Congress Party squandering public funds to gain advantage for Chief Minister and her party in elections. Even the number of advertisements issued by Government increased manifold (fivefold) during election year. Approximately Rs. 22.56 crore of public funds were spends by Chief Minister for purely personal purposes and converted to her own use.

It may be mentioned that former BJP Pradesh President Sh. Vijender Gupta had filed a complaint before the Lokayukta of Delhi in this connection who in his order dated 22.5.12 recommended to administer a caution to the Respondent for being actuated, in publishing and releasing advertisements purporting to be Government advertisements in the year 2007 – 2008, in furtherance of the campaign strategy as revealed in the article titled “Sheila Ki Campaign Ranniti”, actuated by improper motives and personal interest, thereby misusing her position to obtain gain/ favor for herself and her party in violation of the norms of integrity and conduct which ought to be followed by a Chief Minister/Minister and the Lokayukta also recommended to advice the Respondent to reimburse, either herself or through her party, being beneficiaries, a sum of Rs 11 crores, being approximately 50% of the cost of advertisements in the election year. 

Shri Goel and Shri Gupta further said that the aforesaid finding of Hon’ble Lokayukta clearly shows that Smt. Sheila Dikshit being the Chief Minister and Minister Incharge of Information and publicity hatched a conspiracy with other persons, the object of which was that being entrusted with public funds/ State Exchequer and having the dominion over state funds to dishonestly misappropriate and convert the same to her own/party use. For achieving the aforesaid objectives she dishonestly used funds amounting to Rs 22.56 crores in violation of directions of law prescribing the mode in which being a trustee of those funds, has to discharge and committed criminal breach of trust in the capacity of a public servant and also allowed other persons so to do and also committed criminal misconduct punishable under Prevention of Corruption Act, 1988. 

They have demanded immediate action against Smt. Sheila Dikshit under India Penal Code and Prevention of Corruption Act, 1988. Senior BJP leaders Pawan Sharma, Vijay Jolly, Shikha Rai and Jai Prakash accompanied former BJP Delhi Pradesh President Shri Vijender Gupta in filing the aforesaid complaint.
