Ban on Power of Attorney in Delhi

FUTURE OF LAKHS OF PEOPLE IN DARK DUE THE NEGLIGENCE OF DELHI GOVERNMENT

BJP Delhi Pradesh President Shri Vijender Gupta has demanded the Government that it should immediately file a review petition in the Supreme Court against the ban of registration-transfer on Power of Attorney, Agreement to Sale and Will so that the future of Lakhs of people may be saved.

Shri Gupta told that the Supreme Court has by an order stopped the sale of property made between 11th Oct, 2011 to 30th April, 2012 through Power of Attorney, Agreement to Sale and Will. Due to this disputes have arisen in thousands in Delhi and NCR. Supreme court has in its order said that the people who have purchased/sold their properties through Power of Attorney, Agreement to Sale and Will between 11th Oct, 2011 to 30th April, 2012 shall not be entitled to become the owners of the land. These peoples shall be entitled only to look after the land.

It may be mentioned that the land in all the unauthorized colonies is transferred only through Power of Attorney and Agreement to Sale. The problem has arisen that the vendors of the land who have sold their property between 11th Oct, 2011 to 30th April, 2012 say that they are the real owners. Due to this, the persons who purchased the land feel to have been cheated.

Shri Gupta further told that had the intentions of Delhi Government been good then it could have filed review petition in the Supreme Court on 11th Oct, 2011. But the Government remained silent now. The Delhi Government has framed a rule that the purchaser of the land may become the owner on getting a certificate from the registrar office after making payment of a Tax equivalent to 6 percent of Circle rates. Now, what will happen to the people, who made the deals after 11th Oct, 2011.
